Terms of Service

These terms apply when your venue uses ORDRX. By creating an account or running an ORDRX kiosk, you agree to them. If you are agreeing on behalf of a business, you confirm you are authorised to do so.

The short version: month-to-month, cancel whenever you like. Your Square account, your menu and your sales stay yours. We are a small Australian business and we say plainly below what we can and cannot promise.

Who we are

ORDRX is a registered business name of an Australian sole trader, ABN 29 844 156 327. You can reach us at info@ordrx.com.au.

What ORDRX does

ORDRX is self-ordering kiosk software: an Android kiosk app, an optional kitchen display, a dashboard for your staff, and the cloud service joining them. It works on top of your own Square account — ORDRX reads your Square menu and sends orders and payments through Square.

You need your own Square account, and your use of Square is governed by your agreement with Square, not by these terms. ORDRX is not affiliated with Square. We do not process card payments and we never see card numbers.

Your account

You are responsible for what happens under your account, including keeping your login and your kiosk staff PIN to yourself. Tell us promptly if you think someone else has access.

You must not resell or sublicense ORDRX, attempt to break into parts of the service that are not yours, or use it to break the law.

Plans and payment

Plans are billed monthly in advance, in Australian dollars, through Stripe. The plan you are on and what it includes are shown on your billing page and on our pricing page.

Our prices do not include GST, and no GST is charged. ORDRX is not registered for GST, so what you are invoiced is what you pay. Invoices show our ABN.

Where a free trial is offered, we will not charge you during it. If you do not cancel before it ends, the plan begins and the first month is charged.

We may change prices, but not without telling you at least 30 days beforehand. If a price rise does not suit you, cancel before it takes effect.

Cancelling

There is no lock-in. Cancel from your billing page at any time and your plan runs to the end of the month you have paid for; we do not pro-rata refund part-months. Nothing stops working the moment you cancel.

We may suspend or close an account that has not paid, that is being used to break the law, or that is putting the service at risk for other venues. Unless the situation makes it impossible, we will contact you first.

Your data

Your menu, your orders and your sales are yours. We hold them to run the service for you, and we do not sell them or use them to advertise to your customers. What we collect and why is set out in our Privacy Policy.

After you close your account we remove your data from our production systems, keeping only what tax and legal obligations require. Ask us before you go if you want an export.

Availability

We work to keep ORDRX running, but we do not promise it will never be unavailable. Kiosks depend on things outside our control — your internet connection, your hardware, and Square's own services — and we sometimes take the service down briefly to update it.

ORDRX kiosks keep taking orders through many short interruptions, but no software is proof against a venue losing its internet. Keep a way to take orders without a kiosk.

Our responsibility to you

Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law. Nothing in these terms limits those rights.

Beyond those guarantees, and to the extent the law allows: we are not liable for lost profits, lost sales or other indirect loss, and our total liability to you for any claim is limited to the fees you paid us in the 12 months before it arose. Where the law allows us to, we will meet a liability by supplying the service again or paying the cost of doing so.

Changes to these terms

We may update these terms. If a change materially affects you we will give reasonable notice by email or in the dashboard, and continuing to use ORDRX after it takes effect means you accept it. The current version always lives at this address.

Governing law

These terms are governed by the laws of New South Wales, Australia, and the courts of that state have jurisdiction.
